Introduction

Banks and other similar organisations have long charged high penalties if you go over your overdraft limit, forget to pay your credit card bill in time, bounced a cheque, or had a direct debit go unpaid. Penalties have often been £30-£35 for each instance.

It’s now clear that such penalties are not acceptable under contract law. You should only ever be charged the costs borne by the bank as a result of going over the limit or being late with a payment.

Experts estimate the real cost to the bank as being between £2 and £5 each time. You deserve a refund.

Who can reclaim unfair bank (and other similar) charges?

Anyone in England , Wales , or Northern Ireland who has paid unfair charges in the last 6 years. In Scotland it’s 5 years.

Have my charges been unfair?

If you’ve been charged more than £5 for a late payment, going over your overdraft limit, a bounced cheque, or a failed direct debit then we may be able to claim these unfair charges for you. It’s your money, get it back!

How does it work?

  1. A letter is sent to your bank (or similar organisation) requiring information on how much they have charged you in the last six years. They have to provide the information under Data Protection Rules.
  2. Once the information is received a second letter is sent. This time a request is made for a full refund of the above amount with interest. Some banks will pay in full at this point, or offer a settlement figure.
  3. If not paid immediately a third letter is sent threatening court action if it’s not paid in two weeks. Many more banks will pay at this point, or offer a settlement figure.
  4. If the bank still does not pay court proceedings are initiated using a simple online system. Almost all banks that have not yet paid or offered to settle have done so at this point.
